I got an eviction notice in Clark County
The notice you were handed has a clock attached to it. What that clock is
depends on which notice it is. Read the notice itself first — it has to say which kind it is.
What to do first
1. Find out which notice you have. A 5-day, 7-day or 10-day "pay or quit"
notice means you're behind on rent. A notice that isn't about rent (lease violation, no-cause,
end of term) runs on a different clock. Don't guess — use the
deadline calculator
with the date you were served to get your deadline.
2. If you can pay, pay before the deadline. Nevada law says a landlord cannot
refuse rent you try to pay after a pay-or-quit notice just because you also owe late fees or
other charges (NRS 40.253(11)). Get a receipt.
3. If you plan to contest it, file your affidavit with the court before the deadline,
not after. The notice has to tell you which court. You file an affidavit stating why
you're not guilty of unlawful detainer (you paid, you weren't late, the notice was
wrong, etc.) before the close of business on the deadline day. (NRS 40.253(3) for
rent notices; NRS 40.254(1)(c) for other notices.) If you miss it, the landlord can ask the
court for a lockout order without the hearing a timely affidavit gets you (NRS 40.253(5)–(6)).
Get help right away: in some cases a court can still set the order aside (JCRCP Rule 60).
4. Go to the Self-Help Center before you file anything. They have the actual
affidavit forms and will not charge you to use them.
How many days you have
| Notice type | Response window | Source |
| Nonpayment of rent, residential | 7 judicial days after service | NRS 40.2512(1)(b) |
| Nonpayment of rent, commercial | 5 days after service | NRS 40.2512(1)(a) |
| Nonpayment, mobile home lot | 10 days after service | NRS 40.2512(1)(c) |
| Short-term tenancy (rent by the week, 45 days or less) | 4th full day, noon, instead of 7th judicial day — landlord's choice | NRS 40.253(1)(b) |
| Unlawful business / nuisance / waste / illegal subletting | 3 days after service to surrender | NRS 40.2514 |
| Other lease violation (any other covenant) | 5 days after service to perform or surrender | NRS 40.2516 |
| No-cause or end-of-term notice to surrender | First a 30-day notice (7 days if you rent week to week). Then a 5-day unlawful detainer notice: file your answer by close of business on the 5th judicial day after service. If you're 60 or older or have a disability, you can ask in writing, with proof, for 30 more days (not for week-to-week) | NRS 40.251; NRS 40.254(1)(c) |
| Appeal of a court's eviction order | 10 judicial days after the order is entered | NRS 40.385 |
"Judicial day" skips weekends and Nevada's legal state holidays (NRS 236.015) —
that's why the calculator matters more than counting on a regular calendar.

Good to know
The affidavit form itself doesn't require a lawyer to fill out: name, address, the date you
were served, and a plain statement of why the notice is wrong (paid, not late, never served,
wrong amount). Keep a copy of everything you file and everything you're handed. An eviction case
file is sealed automatically when the case is dismissed, 10 judicial days after the court denies
it, or 31 days after you file your affidavit if the landlord never files. If you were evicted,
you can still ask the court to seal the file (NRS 40.2545).
